A former prosecutor called out Bill Cosby's bizarre behavior at his sexual assault trial, where the jury has told the judge they're deadlocked.
Yodit Tewolde, a criminal defense attorney, and former prosecutor Dan Schorr said on "Happening Now" that if Cosby gets off on a hung jury, his trial behavior could negatively impact a future jury's thinking.
Cosby, 79, was reported to have grinned childishly at the trial a few days ago as the judge read to the jury a detailed deposition in which he described his sexual encounter with accuser Andrea Constand.
Cosby is accused of drugging and sexually assaulting Constand at his home in 2004.
A week ago, Cosby attempted to crack a joke as he exited the courtroom following testimony by Constand.
"It was insensitive obviously. It's doesn't look good optics-wise. ... That was not smart," said Tewolde, adding that the deadlocked jury is a good sign for the disgraced comedian and actor.
She pointed out that the current jurors aren't seeing his behavior, while Schorr said his antics might be considered by jurors in a potential retrial if no verdict can be reached.
